SUMMARY

Ontario Immigrant Nominee Program (OINP)

This stream under the Ontario Immigrant Nominee Program gives foreign workers with a job offer in specific in-demand occupations, such as in agriculture, construction, trucking or personal support work, the opportunity to apply to permanently live and work in Ontario.
This stream is operated under an expression of interest system. You can only apply if you first register an expression of interest (EOI) and are issued an invitation to apply.

MINIMUM REQUIREMENTS

The following requirements must be met if you are applying to Employer Job Offer: In-demand Skills Stream:

1- Job Offer Requirement

At the time of your application and at the time the OINP assesses your application for nomination, you must have a bona fide full-time job offer from an Ontario employer in an eligible occupation. Your job offer must be full-time (at least 30 hours per week) and permanent (meaning job has no end date).
The position offered must be in one of the following occupations in National Occupation Classification (NOC) TEER 4 or 5 (➨Appendix 1):

To qualify under the Ontario Job Offer: In-Demand Skills Stream, your Ontario employer must:
  • have been in active business for at least three (3) years prior to submitting your application
  • have a minimum of $1,000,000 gross annual revenue in a location inside the Greater Toronto Area (GTA) or $500,000 outside GTA
  • have a minimum 5 full-time employees who are Canadian Citizens or Permanent Residents  in a location inside the Greater Toronto Area (GTA) or 3 full-time employees outside GTA

2- Work Experience in Ontario

You must have at least nine (9) months of cumulative full-time (or the equivalent in part-time) paid work experience in Ontario within the last three(3) years, in the same in-demand occupation (same NOC code) as your job offer.
You must have gained this work experience within the three years prior to submitting your application while legally living and working in Ontario.
For part-time work, you can work less than 30 hours/week as long as it adds up to 1,200 hours. Any hours of work above 30 hours/week is not counted.
If you need a licence or other authorization for the job that you have been offered, you must have it when you apply.

3- Language Ability

You must have taken an approved test results and have obtained a minimum score of Canadian Language Benchmark CLB 4 in all for abilities in English or French (➨Appendix 5).

4- Education

You must have a Canadian secondary school (high school) diploma or credential, or its equivalent in another country.

If you completed your studies outside of Canada, you need to get an Educational Credential Assessment (ECA) (➨Appendix 3) that proves your education is equivalent to a Canadian high school diploma.

The ECA Report must not be more than five (5) years old prior to the date the application is submitted.

5- Legal Status in Canada (if applicable)

If you are applying from within Canada, you must have legal status (a visitor record, study permit, or work permit) at the time you apply and should maintain that status until the time of nomination.

6- Ineligibility

You are not eligible to apply under the Ontario Job Offer: In-demand Skills Stream if you are a refugee claimant in Canada, a failed refugee claimant, had a removal order, are prohibited from entering or being in Canada, do not have status in Canada or are living illegally in your country of residence.

WHAT STEPS SHOULD YOU TAKE?

Step 1: Get a Job Offer and Work in Ontario

Before you can submit your application under the “Ontario Job Offer: In-Demand Skills Stream”, you must have a bona fide full-time job offer from an Ontario employer in an eligible occupation. You must also have completed equivalent of nine (9) months authorized work experience in Ontario within the past three (3) years and in the same occupation.

If you don’t already have a qualified job offer with the criteria explained in “Minimum Requirements”, you need to find an employer and secure the job for yourself.

After you have obtained an offer of employment from an Ontario employer, you need to apply and receive a work permit. Your work permit will be an employer-specific work permit meaning that it lets you work in Canada according to the conditions on your work permit.

Before you submit your application for an employer-specific work permit, the employer who wants to hire you must complete certain steps and give you either a copy of a Labour Market Impact Assessment (LMIA) (➨immilib.com/LMIA) or an offer of employment number (if the job is LMIA exempt or you are work-permit exempt) to include in your application.

Step 2: Submit an Online OINP Expression of Interest

If you meet the minimum criteria, you can register and submit an Expression of Interest to OINP. You must create a candidate profile within the OINP e-filing Portal (➨immilib.com/OIDS-Apply). Within the portal you must choose the Employer Job Offer: In-Demand Skills Stream and follow the instructions to submit the Expression of Interest (EOI).
Following submission you will be able to check the most up-to-date information regarding the status of your application at any time by logging in. If you are selected, you will receive a message in your Portal account including an Invitation to Apply (ITA).
Your expression of interest registration will remain valid for up to 12 months until you receive an invitation to apply or until you withdraw your registration.

Regional Immigration Pilot
Periodically, OINP conducts general draws as well as targeted draws for “Regional Immigration Pilot” candidates”.
A number of nominations under the employer job offer category are set aside for applicants destined for the following participating pilot communities:
  • Chatham-Kent
  • Cities of Belleville and Quinte West
  • City of Cornwall

Step 3: Submit Application to OINP

If you are selected from the candidate pool and receive an invitation to apply, you may submit your application online and pay the application by credit or debit card in the OINP e-filing Portal (➨immilib.com/OIDS-Apply).  You application must be submitted within 14 calendar days of receiving the ITA.
All supporting documents must be scanned and uploaded in your online application and you need to submit a complete application online in the OINP e-filing Portal.

After you submit your application, you will receive an email confirming that your file has been received and accepted for processing. This will include your OINP file number.
You can check the status of your application through your account in the OINP e-Filing Portal.
If your application is successful, you will receive a Nomination Approval Letter and an OINP Certificate of Nomination by email. You will also receive a work permit support letter so you can apply for work permit and start living and working in Canada while your application for permanent residence is in process.
Your nomination is subject to the following conditions until you receive permanent resident status:
  • You must continue to demonstrate on a reasonable basis an intention to reside in Ontario; and
  • If you are already working for your employer in Ontario, you must continue working until you become permanent resident.  If you are not, you must begin working for your employer when you obtain your work permit and continue working until you become permanent resident.

Step 4: Apply for Permanent Residence

If you are nominated by the province of Ontario, then your next step is to submit a complete application for a permanent resident visa within six (6) months (➨Page).

You must submit your application using the IRCC Permanent Residence Portal (PR Portal) (➨ immilib.com/PR-Portal). 

If your application is complete, you will receive a letter or an email confirming that your file has been received and accepted for processing. This letter is called the Acknowledge of Receipt (AOR) and will include your IRCC file number.
Once you have received your acknowledgement of receipt, you can create an online account and link your application to it. By creating an account, you will be able to receive email updates and a more detailed case status.
Apply for a Temporary Work Permit

When you receive a Nomination Approval Letter and an OINP Certificate of Nomination, you will also receive a work permit support letter so you can apply for work permit (➨Page) and start living and working in Canada while your application for permanent residence is in process.

Your work permit support letter document is valid for six (6) months. If you require an extension to your work permit and your work permit is due to expire within three (3) months, and then you may submit a request for a work permit support letter extension.
You may apply for BOWP only if your PR application is approved in principle meaning you have passed the eligibility stage and still have to pass the medical, security and background checks.

Step 5: Landing in Canada

If your application is approved, you will be asked to pay your right of permanent residence fee if you haven't already done so. You will receive a Confirmation of Permanent Residence (CoPR) and if you are from a country that requires a visa you will also be issued a permanent resident visa.

You will only become a Permanent Resident of Canada when you cross a Canadian port of entry. This is referred to as ‘landing in Canada' (➨Page).

You must land in Canada before the expiry date, which appears on your Canada Immigration Visa. Usually, the expiry date is one (1) year from the time medical examinations were completed. As this is not always the case, be sure to verify the expiry date as soon as the Canada Immigration Visa is received.
