SUMMARY

Yukon Nominee Program (YNP)

This program is for entrepreneurs who want to live in Yukon Territory. They must start a new business or buy an existing business and must actively participate in the day-to-day management of the business.
Approved applicants must operate a business in Yukon on a Work Permit (WP) before being nominated for permanent resident status in Canada.
You may partner with up to two (2) foreign national applicants, Canadian citizens or permanent residents. Your foreign national business partner must also meet all the requirements.

MINIMUM REQUIREMENTS

The following requirements must be met if you are applying to Yukon Business Stream:

1- Education

You must have a minimum of Canadian high school diploma or equivalent foreign credential. If your business requires more education, you must also provide proof of these credentials.

2- Net Worth

You must have a verifiable personal net worth of at least $500,000 CAD of which $300,000 CAD must be liquid and unencumbered funds. Your personal net worth must be legally obtained and must be verified by a Yukon accounting firm.

3- Business Experience

You must have at least:
  • three (3) years of entrepreneurial or business management experience; and
  • five (5) years work experience that is relevant to your business.

You must hold a position within your current business of National Occupational Classification (NOC) TEER 0 or 1 (➨Appendix 1).

4- Language Ability

You must have an approved test results taken within the past two (2) years and meet the minimum score of Canadian Language Benchmark CLB 4 in all for abilities in English or French (➨Appendix 5).

You are not required to demonstrate your language proficiency at the time of application, however, being proficient in English and/or French is a mandatory requirement for nomination for Yukon Business Stream and must be provided when it’s time to request for nomination.

5- Ineligibility

You are not eligible to apply under the Yukon Business Stream if:
  • You have been denied immigration by the Government of Canada.
  • You have an active application for any other provincial or territorial nominee program.
  • You are a refugee claimant in Canada, a failed refugee claimant, had a removal order, are prohibited from entering or being in Canada, do not have status in Canada or are living illegally in your country of residence.

YUKON BUSINESS REQUIREMENTS

In order to qualify as an eligible business under the Business Stream, you must have an intention to buy or establish a business in Yukon that meets the following criteria:

1- Business Investment

You must invest a minimum of $300,000 CAD into starting or buying a business in the first two (2) years.
This does not include any capital investments made before your acceptance into the Yukon Business Nominee Program.
Capital investments include purchases such as property or equipment. It does not include purchases such as a house, vehicles that are only partially for the business and operational or maintenance expenses.

2- Business Ownership

You must own at least one third (33.33%) of the equity of a business in Yukon.
If purchasing an existing business, the business must have been in continuous operation by a Canadian or Permanent Resident in Yukon for the previous one (1) year. It must also be actively in operation.
You must have not yet purchased or started your business in Yukon at the time of your application to the program.
If you have applied with partners and partnership breaks down, the remaining partners must re-organize within a re-negotiated agreement to maintain nomination status.

3- Type of Business

The business purpose must be to make a profit from active income through the sale of goods and/or services.
Your Yukon business must belong to any one of the following strategic sectors:
  • Information technology
  • Manufacturing
  • Value-added processing
  • Forestry
  • Tourism products, attractions, services and facilities
  • Energy
  • Mining or mineral development
  • Agriculture
  • Cultural industries
  • Film and video production
The following types of businesses are not eligible under the Yukon Business Stream:
  • Passive investments
  • Retail, wholesale operations, distribution operations
  • Restaurants
  • Financial services
  • Business, consultation and personal services
  • Most professional services
  • Real estate
  • Holding companies
  • Gas stations

4- Active Management

You must provide active and on-going participation in the day to day management and direction of the business at the business site.

If you meet the above minimum requirement, then you must calculate your total score based on the following selection factors (➨immilib.com/YB-Grid – page 5). You must achieve a score of 65 in the application assessment in order to qualify under the Yukon Business Stream.

Factor 1: Language Ability

To be awarded point for language, you must have taken an approved test results (➨Appendix 5). Test must be taken no more than two (2) years prior to submission of Expression of Interest (EOI).

The lowest score achieved in the four (4) skills (Reading, Writing, Speaking, and Listening) is your score.

WHAT STEPS SHOULD YOU TAKE?

Step 1: Exploratory Visit

Although not mandatory, it is recommended that prior to being invited to submit an application or prior to interview by YNP staff, you make a business trip to Yukon. The main purpose of the trip is to gain knowledge of Yukon’s business environment and what is required to turn a working business concept into a business plan.

Step 2: Registration or Expression of Interest (EOI)

You must submit a registration application to the YNP containing a summary of your business proposal, and all required information by mail (➨immilib.com/YB-Apply).

If your application meets the requirements of the YNP, the application is approved to join a pool of applicants for a period of six (6) months.

If selected by the YNP, you will be invited to submit your full application by mail.

Step 3: Prepare documents

In addition to the applications forms and supporting documents, before submission of complete application, you need to prepare a complete Business Plan as well as a Settlement Plan.
1. Business Plan
You must submit a business plan that demonstrates that the business will be viable and likely to provide material economic benefit to the economy of Yukon as a whole or to the local economy where the business will be located.
Your business plan will be reviewed to ensure that it meets program requirements and the commitments made in your EOI. Thus, this document should be drafted as an essential component of your application.
2. Settlement Plan
Part of your application must include a plan demonstrating how you will relocate yourself and your family to Yukon and take up permanent residence in one of its communities. The Settlement Plan will be reviewed with you during your interview. It is an important document demonstrating your knowledge of Yukon, its residents and his or her ability to integrate into the community.

Step 4: Submit the formal YNP application

Following receiving an invitation to apply, you are expected to submit  your application by providing the following:

  • Application Forms;
  • All supporting documentation;
  • A Business Establishment Plan; and
  • A Settlement Plan

If you submit a complete application, it will be assessed against the eligibility criteria and your business plan.

If the full application meets the requirements of the YNP, you will be invited to a mandatory interview in Yukon. You will receive a formal letter (by e-mail or postal service) communicating the decision.

If your application is accepted, Nominee Program staff will advise you in writing and begin developing a Business Performance Agreement with you. The Business Performance Agreement contains the terms under which you will execute the business and is based off of the submitted business plan.

Step 5: Apply for Work permit

If approved by YNP, you will become a candidate and will be issued a Letter of Support stating Yukon's recommendation to IRCC so you can apply for a two-year work. A work permit allows you to settle in Yukon and operate your business.

You must then provide the letter of support and your business plan to the Government of Canada with an application for a temporary work permit.

You must apply for your work permit (➨Page) within six (6) months of the date on the letter of support.

Step 6: Business Establishment in Yukon

If your application for a Work Permit is approved, you will be expected to arrive in Yukon within two (2) weeks after arrival in Canada.
On arrival, you must meet with YNP staff, to submit the appropriate documentation and sign a Performance Contract. During the meeting an Officer will be available to answer questions related to fulfilling the terms of the Business Performance Agreement and also refer you to other service providers for relevant information and guidance related to the establishment of your business or settlement in Yukon.
Upon arrival in Yukon, it is recommended that you start operating your business. You must meet the requirements of your Business Performance Agreement during the two year period before you are eligible for nomination.

Step 7: Request for Nomination

Once YNP staff has evaluated your business and determined that you have fulfilled all of the requirements of your Business Performance Agreement, you will be issued the letter of approval to you to become a nominee.
If YNP staff decides to recommend your nomination, the Government of Yukon will issue a nomination certificate to you.

Step 8: Apply for Permanent Residence

If you are nominated by the Yukon Territory, then your next step is to submit a complete application for a permanent resident visa within three (3) months (➨Page).

You must submit your application using the IRCC Permanent Residence Portal (PR Portal) (➨ immilib.com/PR-Portal). 

If your application is complete, you will receive a letter or an email confirming that your file has been received and accepted for processing. This letter is called the Acknowledge of Receipt (AOR) and will include your IRCC file number.
Once you have received your acknowledgement of receipt, you can create an online account and link your application to it. By creating an account, you will be able to receive email updates and a more detailed case status.

Step 9: Landing in Canada

If your application is approved, you will be asked to pay your right of permanent residence fee if you haven't already done so. You will receive a Confirmation of Permanent Residence (CoPR) and if you are from a country that requires a visa you will also be issued a permanent resident visa.

You will only become a Permanent Resident of Canada when you cross a Canadian port of entry. This is referred to as ‘landing in Canada' (➨Page).

You must land in Canada before the expiry date, which appears on your Canada Immigration Visa. Usually, the expiry date is one (1) year from the time medical examinations were completed. As this is not always the case, be sure to verify the expiry date as soon as the Canada Immigration Visa is received.
